When the defendant posts bail, they swear an oath of allegiance to appear in court, and they are then held in jail until their trial date. In exchange for their bail bond, they agree to post monthly or yearly payments, along with any other collateral required by the court. Collateral can be any property that is of value, such as jewelry, cash, vehicles, or real estate (if the suspect has collateral there).

What is bail money used for ?

The major issue of where does bail money go comes into play when a person is released from jail on their own recognizance (no money is present), or on the completion of their bail. Once they are free to return to their home, their bail money should be applied to any outstanding court fees, fines, or post-trial costs. However, if a defendant fails to appear at their scheduled court dates, they face criminal charges again. Unless they have posted bail money, they will be held in jail until their trial date.
